HailScan — Terms of Service

Effective date: October 26, 2026

HailScan is a service operated by William Addis, an individual and sole proprietor. It is not a corporation or limited liability company. In this document, "we" and "us" mean William Addis. These Terms govern your use of hailscan.app and the HailScan service (the "Service").

1. Acceptance and eligibility

By creating an account, requesting access, ordering a report or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service. We do not knowingly collect data from children under 13.

2. What HailScan is and is not

HailScan provides storm intelligence for roofing businesses: property monitoring and hail alerts, dated weather reports and videos for an address and date, canvassing lists, field photo documentation, building-code lookups and a CRM.

A HailScan report documents severe weather reported near a location in public U.S. government records (such as NOAA Storm Prediction Center preliminary storm reports and NOAA MRMS radar hail estimates). It does not confirm that hail struck or damaged any structure. It is not a damage assessment, inspection, insurance adjustment, claim recommendation, legal advice or expert testimony, and no AI-generated or automated output from the Service is professional, engineering, insurance or code-compliance advice. Radar-derived hail data is based on NOAA MRMS radar hail estimates; radar-derived or map imagery appears only as labeled visual context. Where a report includes radar-estimated data (NOAA MRMS/MESH), that data is an estimate, not a ground measurement. This report is not a property inspection, an engineering or forensic determination, or proof of damage or coverage. You are responsible for how you use and describe a report, including in conversations with homeowners and insurers.

3. Accounts

You are responsible for:

Notify us immediately of any unauthorized use.

4. Your content and the people in it

You may upload photos, notes, addresses and contact details of customers or property owners into the Service. You confirm that you have the right and any required notice or consent to collect and upload that information, and to use it for the purposes you use it for, including any calls, texts or emails you send to those people. You keep all rights to your content. You grant us a non-exclusive, royalty-free license to store, process, display and transmit it only as needed to provide the Service, including creating thumbnails, previews and generated reports.

5. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate these Terms.

6. Subscriptions and payments

Paid plans are billed in advance through Stripe on the billing period you choose. Subscriptions renew automatically until cancelled. You can cancel at any time through the billing portal; cancellation stops future renewals.

7. Availability and changes

We make no guarantees regarding uptime or availability. We may modify, suspend or discontinue features, and perform maintenance, with or without notice. Public data sources we rely on may be delayed, incomplete or unavailable.

8. Termination

You may stop using the Service at any time. We may terminate your account with 30 days' notice for any reason, or immediately for violations, fraud or non-payment. After termination you have 14 days to export your data, after which it may be deleted. Termination does not entitle you to a refund. Sections that by their nature should survive termination will survive.

9. Disclaimers

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT DATA OR REPORTS ARE ACCURATE, COMPLETE OR UNINTERRUPTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE LESSER OF (A) $1,000 USD OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

12. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute shall be brought exclusively in the state courts located in Henry County, Illinois, or in the United States District Court for the Central District of Illinois (Rock Island Division), and you consent to personal jurisdiction there. Nothing limits any non-waivable consumer rights under the law of your place of residence.

13. Third-party services

The Service relies on third parties, such as payment, hosting, email, SMS, mapping and public government data sources. We are not responsible for their availability or content.

14. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them. If we change these Terms we will update the effective date above. Continued use after a change means you accept it.
